Blinqsy Terms and Conditions

1. Introduction
Welcome to Blinqsy ("we," "us," or "our"). By accessing our website (blinqsy.com), purchasing our NFC products, or using our digital profile services, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use our services.
2. Definitions
"Service" refers to the Blinqsy digital platform, profile hosting, and design services.
"Products" refers to physical goods sold by Blinqsy, specifically NFC (Near Field Communication) cards.
"User" or "Client" refers to the individual or entity using our Services or purchasing Products.
3. Account Registration
To use the Blinqsy platform, you may be required to create an account. You agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
4. Services and Digital Profiles
4.1 Platform Availability
We strive to ensure the Blinqsy platform is available 24/7. However, we do not guarantee uninterrupted access and are not liable for downtime due to maintenance or technical failures.
4.2 User Content
You retain ownership of the information (text, images, links) you upload to your Blinqsy profile. By uploading content, you grant us a non-exclusive license to display this content on your digital profile. You warrant that your content does not violate any third-party rights or laws. We reserve the right to remove any content deemed offensive, illegal, or inappropriate.
5. Custom Design Services
5.1 Scope
We will design your digital profile based on the information and assets (logos, photos) provided by you.
5.2 Client Cooperation
You agree to provide necessary information in a timely manner. Blinqsy is not responsible for project delays caused by your failure to provide content or feedback.
6. Payment Terms
6.1 Pricing
Prices are quoted in South African Rand (ZAR). We reserve the right to alter prices without prior notice, though this will not affect orders already invoiced.
6.2 Deposits and Cancellations
For custom design services and bulk orders:
A 30% non-refundable deposit is required before any work commences.
This deposit covers initial setup, consultation, and administrative costs.
If you cancel the project after the deposit is paid, this amount will not be returned.
6.3 Final Payment
The remaining balance is due upon completion of the design work or prior to the shipping of physical goods, whichever is specified on your invoice.
7. NFC Products (Hardware)
7.1 Shipping
Delivery times are estimates. We are not liable for delays caused by third-party couriers. Risk of loss passes to you upon our delivery to the courier.
7.2 Warranty and Defects (CPA)
In accordance with the South African Consumer Protection Act (CPA):
Manufacturing Defects: We warrant that NFC cards will be free from manufacturing defects for a period of 6 months from the date of purchase.
Exclusions: This warranty does not cover physical damage, water damage, wear and tear, or damage caused by misuse (e.g., bending the card).
7.3 Compatibility
You acknowledge that NFC technology requires a compatible smartphone. Blinqsy is not liable if a third party cannot scan your card due to their device's incompatibility or settings.
8. Returns and Refunds
Custom Goods: Personalized NFC cards and custom-designed digital profiles are non-refundable once production or design work has begun, as they are made to your specifications.
Standard Goods: Non-customized hardware may be returned within 7 days of receipt in its original, unopened packaging for a refund, subject to a handling fee.
9. Privacy and Data Protection (POPIA)
We respect your privacy and are committed to protecting your personal information in compliance with the Protection of Personal Information Act (POPIA).
Data Usage: We collect data solely to provide our services (hosting your profile and processing orders).
Public Profiles: You understand that the nature of Blinqsy is to share information. Any data you place on your public profile is intended for public consumption.
Security: We implement reasonable security measures to protect your data but cannot guarantee absolute security against unauthorized third-party access.
10. Limitation of Liability
To the maximum extent permitted by law, Blinqsy (including its directors, employees, and agents) shall not be liable for any indirect, incidental, or consequential damages, including but not limited to loss of data, loss of profits, or business interruption arising from the use of our Services or Products.
11. Termination
We reserve the right to terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from these terms shall be subject to the jurisdiction of the South African courts.
